ENVIRONMENTAL


Ogletree Deakins’ environmental practice group handles all types of environmental matters, including compliance and enforcement, auditing, litigation, Superfund liability, redeveloping contaminated properties, wetlands permitting, takings litigation, release reporting and other reporting under EPCRA, TSCA, and other laws. The group has extensive experience in toxic tort litigation and has defended all types of cases, including citizen suits, class action personal injury and property damage cases, and state and federal enforcement actions (administrative and civil). Our attorneys have effectively represented clients in permitting actions under RCRA, the Clean Air Act, Clean Water Act, and other environmental laws. We have assisted numerous clients in corporate transactions by evaluating environmental conditions and potential liabilities associated with industrial properties. We work closely with our clients' in-house legal and technical staffs and outside consultants to provide our clients with goal-oriented, efficient legal assistance.

Our environmental practice group secured the nation's first (and one of the few ever issued) delayed compliance order under the Clean Air Act for a client who developed an innovative emission reduction alternative. The order saved the company several millions of dollars in emission control and energy costs. Our attorneys have also successfully challenged various EPA regulations, including effluent guidelines for the textile industry and air emission standards. The group also has extensive experience in mediation of environmental cases and other ADR solutions.

In certain selective cases, the environmental practice group has initiated litigation on behalf of corporate clients in which we pursued and obtained damages for concealed contamination in real estate transactions.
