David J. Comeaux
Profile
David Comeaux practices in the areas of employment law and litigation. He represents management in all legal matters related to the employment relationship and has represented clients in numerous cases involving wage and hour (including collective actions); sex, race, age, religion and disability discrimination claims; and tort and retaliation matters.
He also litigates matters involving restrictive employment covenants, including non-compete, non-solicitation, non-disclosure and similar post-employment obligations. He advises clients in implementing and revising programs as well as review of existing contractual arrangements.
Before law school, Mr. Comeaux worked in various management and professional capacities in the hotel industry, and earned his undergraduate degree from The School of Hospitality Business at Michigan State University. He remains involved in the industry and is an active member of the Academy of Hospitality Industry Attorneys (www.ahiattorneys.org) and the Hospitality Industry Bar Association. He speaks regularly on employment law issues at local and national industry events. In addition to his employment practice, Mr. Comeaux has represented clients in the defense of personal injury matters and in commercial cases, mainly representing clients in the hotel and restaurant industries.
David practiced in Ogletree Deakins’ office in St. Thomas before returning to Houston in 2005. Before entering private practice, David served as a law clerk to Hon. John D. Rainey, United States District Court for the Southern District of Texas.
Experience
David regularly counsels employers in matters ranging from broad policy analysis and review to analysis of specific workplace situations that may call for disciplinary action.
David represents employers in litigation involving all types of employment claims. Some results for clients in various contexts are as follows:
- Awarded summary judgment in several cases of discrimination, harassment, and retaliation
- Avoided conditional certification in a case involving off-the-clock violations against a national hotel management company
- Obtained injunctive relief in cases involving violations of restrictive covenants
- Successfully defended alleged violations of anti-competitive arrangements, including defense jury verdict in case alleging theft of trade secrets by hiring employee from competitor
- Awarded summary judgment in contract action alleging unpaid commissions
- Arbitration award in favor of client in case alleging employment contract breach by early termination
