For fifteen years, Hardy has dedicated his legal practice to the representation of employers in all aspects of labor and employment and wage and hour laws.
Hardy has successfully defended private and public employers in hundreds of adversarial proceedings brought in federal or state courts or administrative agencies that have alleged all types of employment claims under statutory or common law, including wrongful termination, denial of benefits, unfair competition, harassment, discrimination, retaliation and related torts. He represents employers from the initial employee disciplinary notice through arbitration or trial, where he has obtained positive results, including a complete defense verdict after a five day trial on a former employee’s wrongful termination and retaliation claim.
Hardy has also defended numerous employers in complex wage and hour class actions brought under California and federal law, and, in the process, obtained dismissals of wage and hour complaints and defeated class certification motions.
In addition to litigation defense, Hardy regularly advises employers regarding their compliance with federal and state labor and employment and wage and hour laws, including exempt and nonexempt classifications, leaves of absence, employee benefits, personnel policies, occupational safety and health matters, independent contractor relationships, compensation, severance, discipline, restrictive covenants, and single or mass layoffs, terminations and reductions-in-force. He also assists employers with workplace investigations regarding personnel matters.
As for preventative measure, Hardy provides management training regarding all aspects of labor and employment and wage and hour laws, and frequently speaks on these subjects at seminars.
