Lauren H. Zeldin
Profile
Lauren Zeldin practices primarily in the areas of employment discrimination and wage and hour litigation, including the representation of employers in connection with race, sex, age, national origin, religion, and disability discrimination claims in federal and state courts and before various administrative agencies. Ms. Zeldin also has experience representing employers in connection with Rule 23 class actions, as well as collective actions filed pursuant to Section 216(b) of the Fair Labor Standards Act.
In addition to her litigation practice, Ms. Zeldin regularly provides clients with day-to-day counseling and advice on a variety of employment issues, including creating and implementing effective workplace policies and practices, conducting meaningful investigations of complaints of harassment and discrimination, and advising government contactors on affirmative action compliance. Ms. Zeldin has experience conducting internal wage and hour audits and advising employers on how to correctly classify employees under the FLSA. She also represents employers in connection with audits and on-site investigations conducted by government agencies, including OFCCP.
Experience
- Representation of employers in federal and state courts and before administrative agencies in actions alleging violations of employment and civil rights laws, including Title VII, Section 1981, Americans with Disabilities Act, Equal Pay Act, Age Discrimination in Employment Act, Family and Medical Leave Act, Fair Labor Standards Act and related state laws
- Extensive experience defending large retail chains in collective actions brought under Section 216(b) of the Fair Labor Standards Act
- Successful representation of employers in connection with EEOC and OFCCP litigation and enforcement proceedings
- Nationwide representation of restaurant chains in public accommodations lawsuits
- Designed and conducted company-wide FLSA audit for beverage distributor encompassing four locations and more than fifty distinct job positions and advised client on reclassification of improperly classified employees
- Experience advising employers on use of tests and other employee selection devices, including representation of employers in administrative proceedings and litigation challenging those procedures under an adverse impact theory of discrimination
