Matthew A. Carmona
Profile
Mr. Carmona is an experienced litigator in both employment and traditional labor matters in a broad array of industries including telecommunications, the automotive sector and for financial institutions. In this respect, Mr. Carmona represents employers in federal and state courts in all aspects of employment litigation, as well as in administrative proceedings before agencies such as the Equal Employment Opportunity Commission, Michigan Department of Civil Rights and National Labor Relations Board. Mr. Carmona counsels and represents employers in all aspects of discrimination claims (age, disability, race, gender, pregnancy, national origin, religion, ancestry, sexual orientation), sexual harassment, retaliation, FMLA and ADA, WARN Act issues, reductions in workforce issues, wage and hour compliance, wrongful discharge, employment contract negotiation and disputes, non-compete agreements, defamation and other employment torts. He also assists both public and private employers in collective bargaining, Act 312 proceedings, grievance arbitrations, unfair labor practice charges, and other litigation.
Prior to attending law school, Mr. Carmona served as the Labor Relations Manager for The Bureau of National Affairs, Inc. (Bloomberg BNA), a specialized news agency and publisher in the DC area focusing on the effect of government actions on businesses. There, he was responsible for representing management in all aspects of BNA’s relationship with its 900 + member labor union, including employee performance management, grievances, arbitrations, collective bargaining, employment discrimination lawsuits, and counseling managers on a variety of labor and employment issues.
Experience
- Served as second chair for one of the largest Act 312 proceedings in the State of Michigan which resulted in unprecedented employer gains in pension reform.
- Served as second chair trial counsel in defense of a sales representative commission lawsuit in state court, including all pre-trial discovery and motions, creation and management of exhibits, and preparation of jury voir dire, jury instructions and verdict form.
- Served on a team of attorneys that defended a class action retiree health care benefits lawsuit in state court, which concluded with a facilitated settlement between the employer and class members resulting in over $20 million of annual employer savings while maintaining low cost and quality health care options for the class members.
- Spearheaded labor negotiations for major publishing firm that resulted in significant contractual gains for the company, while maintaining the company's well-deserved reputation as one of the best employers in the DC area.
