Tracey T. Barbaree

Profile

Tracey represents employers in all aspects of employment and civil rights litigation, with a focus on Rule 23 class actions and defending collective action claims under the Fair Labor Standards Act.  Tracey also particularly enjoys litigating individual employment discrimination claims in a cost-effective, summary judgment-focused manner that regularly results in dismissal of the claims before trial. 

During law school, Tracey was a managing editor of The Ohio State Law Review and a member of the Order of the Coif.  Tracey also worked as a judicial clerk for the Hon. Richard C. Freeman, U.S. District Court Judge, Northern District of Georgia and continues to rely on insights from that experience in her practice today.

Tracey currently serves as an adjunct professor at Georgia State University Law School and enjoys speaking to students and professional groups on employment law issues.

Experience

Experience: 
  • Employee’s attempt to conditionally certify FLSA off-the-clock claims to include all hourly employees working for a national retailer denied, and individual claims dismissed
  • Decertification of the FLSA claims of a putative class of servers seeking damages for alleged non-server work
  • Assisted national employer with all stages of two major reductions in force, including planning through separation and release agreements
  • Summary judgment on the race, gender, and national origin pay and promotion claims of a long-term employee affirmed by the Eleventh Circuit
  • Denial of plaintiff’s attempt to amend her Complaint to include gender-based pattern and practice claims regarding pay and promotions, despite the pattern and practice allegations in her EEOC charge
  • Class certification of race and gender hiring, promotion, and training claims against national restaurant chain denied
