Aaron Warshaw

Aaron Warshaw is an experienced, senior associate who represents a diverse array of clients in labor and employment matters.  He is one of the founding attorneys of the New York City office.  Aaron’s first-chair experience includes representing Fortune 500 companies in single-plaintiff and class-action employment cases.  He has actively litigated and appeared in many jurisdictions throughout New York State, including before state courts, federal courts, appellate courts, and administrative agencies.  Aaron also is a trusted advisor for management in navigating federal, New York State, and local employment laws.

Aaron served as a judicial law clerk between 2007 and 2010 in the Eastern District of New York to the Honorable Ramon E. Reyes, Jr. and the Honorable Arlene R. Lindsay.  Because of Aaron’s clerkship and litigation experience, he is adept at identifying efficient and creative litigation strategies.  Aaron has actively and personally represented a broad range of clients, including in the retail, hospitality, healthcare, technology, and professional services fields.  He has experience with an vast number of federal and New York employment laws, including:  anti-discrimination laws (Title VII, ADA, ADEA, Equal Pay Act, and New York State and City Human Rights Laws); wage and hour laws (FLSA and New York Labor Law); New York trade secret and restrictive covenant laws; the FMLA; Title III of the ADA; employment contract and implied contract claims; whistleblower claims; WARN Acts; defamation claims; and tort claims.


Experience

Aaron’s extensive labor and employment experience includes:

  • Lead counsel in federal and state employment discrimination cases, including successful first-chair representation throughout court hearings, motion practice, complex written discovery, settlement negotiations before mediators and federal judges, and conducting and defending depositions
  • Assist with federal and state restrictive covenant cases, including first-chair representation at temporary and preliminary injunction hearings, motion practice, and settlement negotiations that have led to multi-million dollar settlements on behalf of clients
  • Assist with federal wage and hour cases, including successful motion practice opposing class certification, all phases of discovery, and conducting and defending depositions
  • First-chair counsel in federal Title III ADA access cases
  • Conduct factual investigations in a variety of litigation and pre-litigation contexts
  • Oversee wage and hour audits, and provide advice regarding compliance with the FLSA and New York Labor Law
  • Appear and assist with appellate motion papers in the Second Circuit and New York State Appellate Division
  • Lead counsel throughout innumerable administrative charges before the EEOC and New York State Division of Human Rights
  • Regularly appear before federal and state labor boards regarding wage and hour investigations, including the U.S. Department of Labor and New York State Department of Labor
  • Selection as a court-appointed Special Master in Eastern District of New York trademark case
