Damon P. Hart represents business in all aspects of employment litigation including complex employment litigation and class actions. Mr. Hart has strong experience in a variety of complex business disputes in the federal and state courts. In addition, his employment practice involves representation of clients before federal, state and local administrative agencies, at arbitration and in state and federal court on matters arising out of Title VII of the Civil Rights Act of 1964, the Fair Labor Standards Act, the Americans with Disabilities Act, and other federal, state and local anti-discrimination and employment statutes.
As evidence of his commitment to the legal and business community, in October 2008, Mr. Hart was given the “40 Under 40” award by the Boston Business Journal. The award recognizes men and women who are under 40 years old and have established themselves as leaders in their respective fields of Business. He was also named an “up and coming” lawyer by Massachusetts Lawyers Weekly in 2007. In May 2005, he was named as one of Boston’s Ten Outstanding Young Leaders by the Boston Jaycees for outstanding professional and community leadership. He joins elite company by winning this award, as former winners include John F. Kennedy, Massachusetts Supreme Judicial Court Justice Roderick Ireland, Thomas Flatley, Leonard Zakim, Bob Cousy and Carl Yastremski.
Mr. Hart has recently served as the Corporate Secretary for the Boston Bar Association and also served as President of the Massachusetts Black Lawyers Association.
In addition to his litigation work, Hart counsels a number of non-profits in their unique business and organizational challenges. In particular he has represented a number of churches and other religious organizations gaining significant experience in constitutional issues, intra-denominational disputes, non-profit administration and tax issues. Mr. Hart serves as outside counsel for Jubilee Christian Church, providing legal advice for its various social and economic ventures, including real estate and economic development, book stores, and an in-house Gospel record company. Mr. Hart also serves as a volunteer in Jubilee’s men’s, youth and children’s ministries.
Mr. Hart worked for the Massachusetts Commission Against Discrimination, while attending law school. In college, Mr. Hart played Division I basketball where he was a four year letterman and played in the 1993 NCAA Tournament.
Experience
Mr. Hart represents employers in suits involving race, sex, age, and disability discrimination, the FMLA and related common law claims. He has obtained summary judgments or dismissals on behalf of clients in a variety of cases, and has successfully defended those decisions in the appellate courts. He has significant experience with the following business sectors: retail, hospitality, transportation, education, restaurants, alcohol and beverage producers and manufacturing.
