Since 2001, Mr. Capozzola has represented employers primarily in wage and hour matters and actions involving discrimination, harassment and related common law claims. He also has experience with restrictive covenant litigation, and he regularly provides employment advice. Mr. Capozzola began his practice in Los Angeles, California. In 2006, after moving to New Jersey, he was admitted to the New Jersey Bar. In 2007, he was admitted to the Bars of Connecticut and New York. With his multi-jurisdictional practice, Mr. Capozzola has a wide range of experience and familiarity with the employment laws of New Jersey, New York, Connecticut, and California, in addition to the applicable federal employment laws. Mr. Capozzola also has significant class and collective action experience.
Experience
Mr. Capozzola has handled a wide variety of cases, ranging from single-plaintiff discrimination cases to wage and hour class actions involving hundreds of putative class members. In a wage and hour class action in which he represented a large company in the life safety industry, he was instrumental in successfully opposing class certification and obtaining summary judgment against the plaintiffs. He then filed a motion for attorneys’ fees that resulted in a settlement agreement which elicited a sizable settlement payment from the plaintiffs. He has also performed class and collective action services for a large hotel company, a national chain of Chinese restaurants, and a transportation company, among others. Mr. Capozzola has handled discrimination cases on behalf of a professional parking management company, a major supermarket chain, and a healthcare company, among many others.
Mr. Capozzola also has appellate experience, and he has been involved with successful appeals matters before the Second, Fifth and Ninth Circuit Courts of Appeals.
