Jessica Fisher has a blended practice of both employment litigation and proactive, preventive advice in many areas of labor & employment law, including anti-discrimination laws (e.g., Title VII and the Age Discrimination in Employment Act), federal and state background check laws (including the federal Fair Credit Reporting Act and the various mini-FCRAs), the Family and Medical Leave Act (FMLA), and the Americans with Disabilities Act (ADA). She assists clients of all sizes and in a variety of industries – from a manufacturer with 30,000 employees to a service provider of 10 employees.
Jessica is a graduate of the University of South Carolina School of Law, where she served as Associate Editor in Chief of the South Carolina Law Review, was a member of the Order of the Coif and the Order of the Wig and Robe, and was the recipient of the Bronze Compleat Lawyer Award in 2009 (the highest award given to a student by the University of South Carolina School of Law). Jessica earned a Bachelor of Arts degree in Political Science, magna cum laude, from Furman University, where she was a member of Phi Beta Kappa.
Experience
Jessica represents management in all aspects of employment law, including employee relations, preventive employment advice, and federal and state litigation involving discrimination, harassment, retaliation, wrongful discharge, noncompetition covenants, and breach of employment agreements. Jessica's recent work includes:
- Successfully representing clients before the Equal Employment Opportunity Commission, from the filing of the charge of discrimination, to the ensuing investigation, and through issuance of right-to-sue;
- Litigating claims arising under federal anti-discrimination statutes and state laws; and
- Advising corporations in connection with background check issues, including the federal Fair Credit Reporting Act and related state mini-FCRAs.
Jessica provides engaging, effective training and real-world advice to in-house counsel, human resources professionals, and managers and supervisors on best practices for compliance with anti-discrimination laws, federal and state background check laws (including the federal Fair Credit Reporting Act and the various state mini-FCRAs), the Family and Medical Leave Act (FMLA), and the Americans with Disabilities Act (ADA).
