Workers' Compensation Practice Group

The defense of employers in workers’ compensation matters is an important service we provide to our clients. Our practice developed directly in response to client demand and the need for quality representation in workers’ compensation matters.  With our experience and skill in employment law, we are better able to advise clients in occupational disease or injury claims, which can be complicated by employment law concerns such as the ADA, FMLA, or retaliatory discharge.

Our practice includes the representation of self-insured and insured employers in workers’ compensation cases.  We assist our workers’ compensation clients on a daily basis in routine claims handling and procedural matters.  We find that most claims can be handled by clients in-house or in cooperation with our clients’ third party administrators without our making a formal appearance.  By offering behind-the-scenes advice, our clients can generally resolve claims quickly, while avoiding many major and costly legal problems such as retaliatory discharge or charges of disability discrimination.

  • Developing supervisor training on effectively handling and investigating claims of injury.

  • Coordinating settlement of workers’ compensation claims with resolution of other workplace claims.
  • Managing return- to- work issues and programs.
  • Managing and coordinating medical, military, and FMLA leaves.
  • Managing the myriad issues associated with employee absences from work.

Frequently, we are asked to represent clients in very difficult workers’ compensation cases involving catastrophic illnesses or injuries, and in situations such as when an employee is unable or refuses to return to work.  We utilize a network of conservative health care professionals who provide first rate medical treatment.  We encourage our clients to work closely with medical providers to design, whenever appropriate, return-to-work programs which can minimize workers’ compensation costs and liabilities. 

We have represented clients in all types of injuries and disease cases.  Our workers’ compensation attorneys have a strong background in and a working knowledge of all related employment and safety and health laws such as OSHA.  Our philosophy is to provide immediate medical attention and fair benefits to injured employees with legitimate claims, while aggressively investigating and defending claims where fraud is suspected.  We are sensitive to client concerns about the cost of legal services.  Our use of our professional staff of paralegals, administrative assistants, and clerks whenever possible and appropriate to handle such matters as obtaining and reviewing an employee’s medical and employment records is intended to provide each client with the highest quality legal services in an efficient cost-effective manner.
